Q: I am currently employed and have insurance through my employer for my husband and me. Since my husband has Parkinson's disease, I am considering retiring to be with him even though I am only 61. My husband retired in January 2007 but did not receive disability. I added him to my employer's group health plan. He will be 65 and eligible for Medicare in December 2009 (28 months from now). I understand that COBRA would cover us both for 18 months. Will his condition make him eligible for the 29 or 36 month coverage... or until his 65th birthday?
A: The maximum amount of time an employee can continue on COBRA is 18 months. However, a dependent may be able to obtain another 18 months for a total of 36 months if a second qualifying event (death or divorce of the employee) should occur. Also, if you be come disabled you can continue for an additional 11 months for a total of 29 months. You must be determined by the Social Security Administration to be disabled to qualify for this extension. The disability must have occurred before or during that first 60 days of your COBRA coverage.
You may be eligible to convert your COBRA coverage to an individual policy from your insurance company if they offer an individual policy.
