Q:  I received a letter from my Cobra Plan in which my check for my July premium was returned. I check with my bank and it was returned July 31, 2007. I did not received noticed from the company until 8/9/2007 and the same day my bank also sent me noticed. I went to the bank and had a cashier check drawn form July and August premium with an appeal letter stating I was on disability and am under medical care and please reinstate my cobra. I send all my payments priority mail to verify delivery and date company received them payments. They denied my coverage stating it was over the 30 days grace and cannot reinstate coverage. What can I do?

 

A:  You have a 30 day grace period after the due date to pay the premium amount in full.  If you can make your payment in this time period then your COBRA coverage will continue with out lapsing.  If it is after the grace period that you are notified of the returned check then your coverage will be terminated.  The previous employer is not obligated under law to allow you to continue the policy if payment has been made after the grace period.  You will need to find other insurance coverage.  If you can’t obtain other health insurance due to your health you can contact the naic.com.
