COBRA coverage and Disability
The HIPPA law states that all qualified beneficiaries, not just the disabled person, have the right to continue with COBRA coverage and take advantage of the 11 month extension. In compliance with the COBRA law, it is possible to extend the 18 months of coverage to a 29 months, if and individual has been determined disabled at the time of a qualifying event. HIPPA has modified the plan by allowing the 11 month extension to consist of those disabilities that may happen before or during that first 60 days of your COBRA coverage. You will need to contact the plan administrator before the end of the 18 month period. You must also notify the administrator no later than 30 days after the individual is no longer qualified as disabled by the law.

my son was carried on my school's insurance. They offered him COBRA coverage when he turned 25. I received notice that he was being dropped due to a clerical error...theirs..not ours. He had massive back surgery when he was 21 and it has been impossible to find insurance for him. Our insurance is united. Can the school district opt to drop his COBRA is we have made a payments in a timely manner? We have paid for 6 months of COBRA insurance. We have applied for SSI but that will take months to get. Meantime we have no insurance and he still goes to the orthopedic dr. and pain managements. Everyone considers the back pre-existing and will write exclusion plans for the insurance. His back is the main reason that we need insurance. I know that we can apply to the State of Texas Pool..bt that takes lots of time and is super expensive. COBRA gave us time to plan. No one wants to hire him with his medical history.
