Q: I had been covered under my wife's medical plan for many years but we have divorced which was final as of Aug 17 th of this year. My ex wife said that I would be covered through the end of May and that I should be receiving info on Cobra through the mail sometime in July of this year. Well as things go I did not even think about it tik now and realized that I have heard nothing. Sure enough I called Aetna my insurance provider and they said that as of Aug 1st I was no longer covered. I have no coverage and I never heard from or was given any info from or about cobra ins. What do I do now since I have no coverage but I would certainly want and would pay for cobra ins if I had been offered it or had heard something. Who should I contact and how do I proceed from here. Please help me as I am very worried and now I am panicking
A: Under COBRA law, your wife’s employer has up to 45 days from the qualifying event to mail you the COBRA packet. Your qualifying event is the day the divorce was finalized or the last day of group benefits, whichever is later. Once you receive the letter you have 60 days to elect COBRA. The COBRA continuation is retro-active, so you will not have a lapse in coverage. I recommend that you contact the HR Department or benefits manager of your wife’s employer to let them know you are waiting for the paperwork.
