Q: I have an employee that is currently age 65 and his last day of work will be 9-28-07 and his medical benefits will end 9-30-2007. If the employee is age 65 at time of termination are they still eligible for Cobra?

A:  Once an employee becomes entitled to Medicare, he is no longer eligible for COBRA.   However, COBRA will be available for the employees spouse and/or dependants and they have the right to elect COBRA for 36 months.
