Q:My COBRApremium is due today for the month of October. I know that I have 60 days to elect COBRA. If I decide, say on October 18, that I want COBRA; can I still pay my premium for the month of October and be covered, even if the due date has passed?
A: You do not have to submit a payment with your election form. If you do not then you must make the 1st payment within 45 days after you elect COBRA continuation (from the date you mailed your election form). Failure to make the initial premium within 45 days will could cause you to lose all COBRA rights. After the initial payment has been made the administrator can set the due dates, they must give you the option to make monthly payments. Also, they must give you a 30 day grace period to send in a late payment. You will need to keep track of your due date because the plan administrator does not have to send you a monthly invoice.
