Q:  Once a person is 65 years old or older, and has had health coverage under a group plan through their employer and because of this has deferred Medicare, would they be eligible for COBRA (the 18 month period) after termination from the group plan, even though they are Medicare eligible also?

A:  The employee over age 65 that is eligible for Medicare can still be eligible for COBRA as long as they don't become entitled (starts receiving benefits)  to Medicare.  Once they become entitled to Medicare they are no longer allowed to continue on the employer’s group health plan. If they have a spouse or any dependants, they may take advantage of COBRA.  The employee can not have COBRA coverage and Medicare benefits at the same time.
