Q:  If a couple is divorced, & the dependant x- spouse takes a job with a company that offers insurance, but ops not to take it, do they qualify?

A:  The dependent is still eligible for COBRA as long as they are not enrolled in their employer's group plan or have other health insurance.  A person can not have COBRA and other insurance at the same time.
