Q: I have a cancellation of insurance effective 11/08/06; I was under the impression from my employers benefit support that my diabetes would not be covered. I negected not to take COBRA and was not put under insurance with my new employee til 02/02/07. This break in coverage is affecting my current pre-existing status. Can I contact my previous employer and request to pay for 2 months of COBRA for previous months; Nov 8-Dec 31, 2006?
A: An employee is given an election period that allows them to choose COBRA continuation. The election period starts when you receive the COBRA packet in the mail and ends 60 days later. You must submit the election form during this 60 day period to your previous employer or their plan administrator.If you don’t elect COBRA coverage during this time you will lose your COBRA rights and you can not sign-up for COBRA at a later date.
