Q:  An ex-employee did not elect COBRA. However, his spouse did. Can the ex-employee elect to go onto COBRA, during the employer's open enrollment period? If not, can the spouse on COBRA, change the coverage from individual to family during the open enrollment period? Thank you.

A:  If an employee doesn't choose COBRA for himself during the election period he can not sign up for COBRA during open enrollment. COBRA continuation can not be changed from an "individual" to "family" because you can’t add the employee at open enrollment.
