My employer changed insurance companies, can I keep the old company?

Q:  I was just forced to switch insurance companies at my work from Blue Shield to CIGNA they did not even give us the option of COBRA so I signed up for CIGNA. I had a bariatric surgery that was scheduled for September 20th. (20 days after my new insurance went into effect) then they told me I had to go through the certification process again, and because they had different requirements they denied me for the surgery even though the surgery was already approved. I was wondering if I can still get COBRA so that I can utilize the approval of my old insurance and stay with Blue Shield for awhile. My work did not even tell me about COBRA otherwise I would have gotten that instead of being forced to get CIGNA

 

 A:   COBRA is a federal law that requires an employer to offer the continuation of their group health plan when the employee looses the group benefits because their hours are reduced or because employment ended for any reason other than gross misconduct. 

A person is not eligible for COBRA when they are still employed and still receiving group benefits.  When an employer changes or switches their health plan to a new insurance company, the old insurance plan is no longer available to any employee.  Also if a former employee is already on COBRA their coverage would be switched to the new health plan from the new insurance company.
