Q:  My husband paid into COBRA at his job which had less than 20 employees. He has recently lost his job and does not qualify for COBRA since the company employs less than 20 people. Can he get refunded from the business the money he put into COBRA? And why would a company that employees less than 20 people have COBRA in the first place?

 

A:  COBRA is not a benefit that an employee pays into when they are employed. COBRA premiums are not deducted from the weekly paycheck. COBRA is a federal law. When an employer has more than 20 employees they must offer the employee continuation of group health insurance when they leave the job for any reason other than gross misconduct.  An employee doesn’t start to pay for COBRA coverage until they elect to continue the group health through COBRA.  If there is less than 20 employees the employer is not subject to COBRA laws however, they can choose to offer the continuation of their group health plan to their employees.  Employers will deduct the premiums for their group health insurance from the employee's paycheck but that is not COBRA
