Q: Does an employer have to have 20 or more employees who are eligible to join the group health plan or does the employer just have to have 20 or more employees to be required to offer COBRA coverage.
A: It doesn’t matter how many employees are on their group plan to be eligible. However, the employer must have at least 20 employees or more during 50% of its typical business days in a calendar year for you to be eligible for COBRA. Both full-time and part-time employees can be counted. Part-time employees are counted has a fraction based on the hours worked.
