Q:  My husband was unfairly terminated for misconduct/insubordination after 20 years of service.  Does this qualify our family of 5 for COBRA benefits?

 

A:  If his previous employer has more than 20 employees, they must offer him COBRA continuation.  Being terminated for misconduct is a qualifying event and your family would be eligible for  COBRA unless the termination was for gross misconduct.  Gross misconduct is a criminal act or doing harm to another employee.  The previous employer has up to 45 days from your husband's last day of group benefits to mail the COBRA packet to you.  If they do not receive this, you should contact the US Department of Labor at 1-866-487-2365.
