Q: I presently have COBRA insurance for myself and spouse. I am now changing to Medicare for myself effective Oct 1, 2007 and will continue COBRA coverage for my husband. The administrator for the COBRA coverage says he can not get an extension past the original 18 months and I originally was told that when I went to Medicare, the time left of my eligibility, would be added to his term. Please advice if I can get his term extended
A: The covered employee that already has COBRA continuation and they become entitled to Medicare, the spouse and dependents can stay on COBRA. When this happens it is called a 2nd qualifying event. The spouse or dependents will receive an additional 18 months of COBRA coverage for a total of 36 months. Your previous employer or plan administrator must offer your spouse the extension; if they do not give your husband this option then you should contact the US Department of Labor at 1-866-487-2365.
