Q:I resigned from my previous employer on 7/21/07. I had Dental Ins. with them and to date have not received any information re: COBRA (11/16/07) 4 months. I have started with a new job with new company but will not qualify for benefits until after 1 year. I had left a vm back in Aug to follow up with former employers and never received a response. 1st week of October I had called and spoke with HR Director and informed her that I had never received any info from COBRA Dental and was concerned. She assured me that she will follow up and call me back. To date I have yet to receive any info from COBRA and never received a follow up call. Please advise me on what my options are to get their attention.
A:It is your previous employer’s responsibility to mail you the COBRA packet. They may have hired a 3rd party plan administrator to handle the COBRA paperwork.Whether it’s the previous employer or their plan administrator they need to send you the election form with in 45 days of your last day of group benefits.The US Department of Labor at 1-866-487-2365 needs to be notified when an employer doesn’t comply with COBRA laws.
