Q: I was recently let go from a company who has insurance group health insurance. They tell me that in order to avoid any lapse in coverage I need to pay by the 20th of the month prior to my coverage last day. That if I wait for the paperwork my coverage will lapse from the last day until payment is received. I am not comfortable I am getting the correct answer. They are also unwilling to write me a letter with these instructions. I want to be covered from the day my insurance ends. How do I accomplish this?
A: Your employer or their plan administrator has up to 45 days to mail you the COBRA packet from your last day of group benefits. Once you receive the election form, you have 60 days to elect COBRA continuation and an additional 45 days to make the first payment. Until your COBRA payment is received your coverage will be “suspended”, when the payment has been processed your coverage is retro-active to your last day of group benefits. There won’t be a lapse in coverage, however, if you have any claims during your election period, you may have to pay them out of pocket and then be reimbursed by the insurance company once the COBRA payment has been received. I’m sure your employer is suggesting that you make the COBRA payment right away so, there won’t be any delays in getting your claims paid. They may have had prior experience of ex-employees having problems obtaining medical treatment or getting their medical bills paid because during the election period you can’t provide proof of insurance to your doctor until the 1st payment is received.
