Q: It’s been longer than 45 days and I have not received any cobra info. I’m with another company now but I have a doctor’s appointment soon because I’m pregnant and need insurance. How soon will I be able to get my insurance back?
A: If your previous employer has more than 20 employees and you were on their group health insurance before you left, you are eligible for COBRA continuation. Your employer is legally responsible for sending you the COBRA packet within 45 days from your last day of group benefits. You should call your previous employer and let them know you have not received the COBRA election form. Once you elect COBRA your coverage is retro-active to the last day of group benefits, so you will not have a lapse in coverage. If your employer doesn't give you the election form, you should contact the US Department of Labor at 1-866-487-2365.
