Q:I was laid off about 7 months ago and was offered by my employer the possibility of staying on the group health (I paid for it all) or going on COBRA. Now I have gone through a divorce and am changing my insurance. Am I still qualified to receive COBRA? Is my ex husband?
A:COBRA is a federal law that requires an employer with more than 20 employees to offer continuation of group benefits to an employee when a qualifying event occurs that causes the employee and their dependents to lose the group health benefits.The employee is responsible for paying the entire cost of COBRA.Being laid-off is considered a qualifying event.If you are currently on your previous employer’s group health plan and paying for the insurance you may already be receiving COBRA benefits.If you ex-husband has his health insurance through your employer, he would be eligible for COBRA continuation too.
