Q:  My husband lost his job.  I was told that an employer has to offer you COBRA within 45 days. They do offer COBRA, they are not a government or small business, they have 100's of employees. The HR person did not like my husband and even tried not to give him unemployment compensation and lost. I feel she is with holding cobra benefits from us because she just doesn’t like him. What are our rights in this case and what should we do? Can we file a complaint?

A:  An employer with more than 20 employees must offer you COBRA continuation coverage.  If the employer does not comply with COBRA laws, they can receive severe fines from the US Department of Labor and the loss of tax credits from the IRS.  You should contact the US Department of Labor at 1-866-487-2365.
