Q:  Currently if an employee and his spouse are covered under COBRA for the 18 months and then are subject to HIPAA  that allow individual insurance to be obtained without proof of insurability; does this apply to the primary (employee) and to the spouse or only to the ex-employee?

 

A:  It applies to  all family members of the employee that chose to continue the group health plan through COBRA.
