Q: I ended my employment (last working day) on Nov. 16, 2007. I was told by my employer I would not be receiving any notification from them regarding future payment/termination of health benefits, and that my only COBRA notification would arrive directly from COBRA within 30 days. As of January 8 I have still NOT received my COBRA information. Is there a way I could receive an update on my benefits?
A: It is your employer's responsibility to make sure you receive the COBRA packet. Your employer is referring to a 3rd party administrator that they hired to handle the COBRA paperwork for them. The employer or their COBRA plan administrator has up to 45 days (from your last day of group benefits) to mail you the COBRA packet. You should contact your previous employer and let them know you have not received the paperwork. If it has been more than 45 days form your last day of group benefits and you still haven't received the packet, you should contact the US Department of Labor at 1-866-487-2365.
