Q:  When an employee notifies us of a divorce and we are to send COBRA information to the spouse (who is not employed with us) is it our responsibility to track them down to find a correct address or can we use the address on file to send COBRA information?

A:  It is the employer's responsibility to inform the employee's spouse of  their COBRA rights.  If you can't obtain a current address from the employee, you must mail  the COBRA packet to the last known address you have on file for the spouse.  Be sure to document everything carefully.  You need to keep record of where you sent the paperwork, the date it was mailed and who mailed it.
