Q: My husband was just terminated. He was offered COBRA. We would like to continue COBRA only for our 20 year old daughter that has a pre-existing condition. Can she be on COBRA even if my husband (the ex-employee) elects not to be?
A: As long as your daughter was on the policy before the COBRA qualifying event, she will be eligible for COBRA continuation. On the election form (that you will get from your employer) you will be able to elect who you want to continue the COBRA coverage. The employee does not have to accept COBRA coverage for themselves to get their spouse or dependent children covered under COBRA continuation.
