Q: My husband retired from his job and placed me (spouse) on his COBRA insurance. We are divorcing and he told me he is taking me off his insurance can he do this and will I lose coverage?
A: You must be given the right to keep the COBRA continuation coverage. The divorce would be considered a secondary qualifying event and you would be able to continue with COBRA for an additional 18 months for a maximum of 36 months. You need to contact your husband's previous employer or their COBRA plan administrator as soon as possible to let them know you want to keep the coverage.
