Q: I am a single mother of two small children and it is my ex-husband's responsibility to provide their health insurance. He recently quit his job and says he extended their insurance through COBRA but their plan) says it was canceled Jan. 1st. How do I find out if he did extend the plan through COBRA and how do I use the insurance for my kids if he did?
A: You should contact his previous employer's HR deparment or benefits manager. The employer or their COBRA plan administrator must provide him with the election form to continue the group insurance through COBRA. It is the same benefits, same coverages as before he left that job. The employer has up to 45 days to mail the COBRA packet to him and he has a 60 day election period. Once he elects COBRA the insurance is retro-active to the last day of group benefits. You may have to pay any medical bills out of pocket and the insurance company will reimburse you when the paperwork has been processed.
