Q:My cobra insurance coverage was cancelled for paying the wrong premium even though the insurance company never sent me notice that there was an increase in my premium. I have a child with a chronic disease and was wondering if I can go back now and have the insurance company reinstate my COBRA because they failed to notify my of the increase?
A:When an employer or plan administrator receives a check for an incorrect amount of premium they must notify the employee immediately. The employer must send a “Payment of Discrepancy Letter” to the employee. The employer or plan administrator can accept the underpayment and let the employee pay and the difference to the next month’s premium. If the underpayment is significantly less the employer must give the employee 30 days to pay the difference.If your employer did not comply with COBRA then you should contact the US Department of Labor at 1-866-487-2365.
