Q: What are my rights to get my Cobra coverage reinstated? I was informed by Conexis that my coverage was cancelled Nov. 07 due to my former Employer cancelling the group plan I was covered under. I was not informed that the former employer "changed" administrators. Should I have been informed of that change and been given the option to continue my coverage? I feel as though I should have been. I have been dealing with not being able to get individual healthcare or not being qualified for HIPAA coverage because my Cobra coverage was not exhausted. I believe my Cobra coverage should be reinstated under the new group plan and that my former employer had a responsibility to inform me of that change and send me the necessary paperwork to continue my coverage as they new I had elected to maintain my healthcare with Cobra upon leaving the organization. Please let me know my rights and options for getting my cobra covered healthcare reinstated for the duration I am allowed.
A: Your employer has the right to "shop" around and change their group health insurance company. However, when the employer changes plans, they have to include their COBRA beneficiaries and allow them to continue the COBRA through the new group health plan. When the health plan changes, the employer must provide you with new ID cards and a Summary of Plan Description, this is usually a booklet that details your new benefits and coverages. You should contact your previous employer to discuss your COBRA continuation. If they will not help you, then you need to contact the US Department of Labor (DOL) at 1-866-487-2365. The DOL regulates the COBRA law and makes sure the employers comply. You may want to contact your state's department of insurance at www.naic.org to see if the have a policy available if you can not get your COBRA reinstated.
