Q: Can a small business elect to offer Cobra for only 9 months? The employer said that because he is a small business he only has to offer Cobra for 9 months.

 

A:  Employers with less than 20 employees are not subject to COBRA law.  They have no “rules” that they must follow when offering continuation of their group health plan.  As long as the group health insurance company allows the continuation,  the small employer can choose their own time limit to offer continuation of their benefits.  However, if the employer has more than 20 employees they have to offer you 18 months of COBRA continuation.
