Q: In a couple of months my company is merging with another and my current insurance company will be changing to theirs which is less favorable, will I be able to keep my current policy under Cobra or will I have to take theirs? And on that note, if I were to quit now and take cobra under the current policy would my cobra coverage change to theirs once the merger is final or may I maintain cobra with current policy?
A: COBRA is a continuation of the employer’s group plan that you had the day before the qualifying event. So, your COBRA coverage would be with the new merging company’s group plan. If you quit before the merger, you would continue the plan you have now and when the merger is complete your COBRA coverage would be switched to the new plan.
