Q: I am currently on COBRA that will end soon. My current carrier is Blue Shield. I have a pre-existing condition. My previous employer was a large group employer (a county in n. California). I contacted their Risk Management who informed me that there were no extensions for COBRA. I spoke with an insurance agent last night who informed me that my pre-existing condition was an automatic decline despite the fact that I will have been on COBRA 18 months without a lapse and that the HIPAA Guaranteed Health Insurance would not help me get insurance.
A: HIPAA only applied to group health plans. If you enroll in an employer’s group plan, they can not decline you or put limitations on pre-existing conditions. You mentioned that your previous employer is in California, if you are a resident of California you maybe eligible for Cal-COBRA. Cal-COBRA is a California issued law that allows a resident employee to continue with the group health plan offered by California employers. You will need to contact the California insurance department for specific Cal-COBRA question. The phone number for the California Department of insurance is 800-927-4357.
