Q: My husband has been offered a new job to start March 10. I am due with a new baby March 27. We will need coverage for 30 days until his new insurance kicks in. I know that I will have this baby during that time. What I need to know is if my husband has to be on the Cobra Insurance (he doesn't need it)? Or if he has to because it was his insurance coverage?
A: The employee does not have to elect COBRA for him/herself to get COBRA for their spouse or dependent children. Your coverage will back date as soon as you send in the election form and your first premium payment. So if you had to seek medical treatment during that enrollment time, you are covered. You will just have to resubmit those bills after the COBRA is in effect.
