Q: I turned in my resignation after ten years. I was put under extreme stress and discriminated against. HR did not brief me on what to do regarding my insurance. After asking several times, I was told that someone with COBRA would contact me. I have not heard from anyone. I turned in my resignation on Jan. 28th and my company terminated my company insurance on Jan. 31st. Please advise on what steps I should take.
A: Your employer is responsible for making sure you receive your COBRA rights and the COBRA election form. When your employer said “COBRA” will be contacting you, they are referring to a 3rd party COBRA plan administrator that they hired to handle their COBRA paperwork. The employer or their COBRA administrator has up to 45 days from your last day of group benefits to mail you the COBRA packet. Once you elect COBRA, the insurance is retro-active, so you will not have a lapse in coverage.
