Q: I was released from my job on 11/26/07 and have not received a COBRA package.My wife had a hospital stay from 2/14/ thru 2/18.Can I still sign up for this coverage or am I too late.
A:COBRA election does have certain time limitations. You have only 60 days to elect COBRA. That is by the 60th day from when the written notice was sent to you or from when your health care coverage has been terminated, whichever event is later. Your employer has up to 45 days to get the letter to you in the mail stating your COBRA rights.
If your employer did not comply with the COBRA law and did not provide you with the COBRA election form then you should contact the US Department of Labor at 1-866-487-2365.
