Q:My daughter did not know about cobracontinuation coverage at her place of work. When she quit she did not have the info and now does not have coverage. What should she do? She was never told about cobra please help
A:If her employer has more than 20 employees the MUST offer her COBRA continuation.It is the previous employer’s responsibility to mail you the COBRA packet.They may have hired a 3rd party plan administrator to handle the COBRA paperwork.Whether it’s the previous employer or their plan administrator they need to send you the election form with in 45 days of your last day of group benefits.The US Department of Labor at 1-866-487-2365 needs to be notified when an employer doesn’t comply with COBRA laws.
