Q: 1. Last day of employer coverage: 2/29/08 2. First day of new individual coverage 4/1/08. 3. A couple of medical claims put in for March. 4. COBRA election material doesn't arrive until 4/5/08. Question: What has to happen for COBRA to pay for the March medical claims if you can't have COBRA and the new policy at the same time? Does one accept the COBRA coverage have them somehow pay the March claims then quit and go forward with the new policy?
A: Since the employer or their plan administrator has up to 45 days from your last day of group benefits to mail you the COBRA paperwork, the coverage is retro-active. Once you receive the COBRA packet you have 60 days to elect COBRA. To get any claims paid that occurred during the election period and before the effective (start) date of your new insurance; you would have to submit the election form and your first payment before the due date. If you receive the election form after your new coverage started, you can still elect COBRA to cover any claims that occurred prior to the effective date of the new insurance and then have the COBRA end on the same day the other insurance starts.
