Q: When we contacted the third party administrator about Cobra we were informed that we did not have "qualifying event," therefore she is not eligible for Cobra. What are acceptable "Qualifying events?"
A: Under COBRA law, an employer with more than 20 employees must offer continuation of their group health insurance to an employee and their dependents when a qualifying event occurs.
What are qualifying events?
For the employee:
1. Voluntary or involuntary termination of employment (unless due to gross misconduct)
2. Your working hours have been reduced
these events apply to the employee’s covered spouses and the dependants.
1. Death of employee.
2. Divorce or legal separation.
3. Loss of dependant status, or when a child comes off of employees insurance due to age or school status.
4. Employee is entitled to Medicare benefits
You can contact your state at www.naic.org to see if they offer a Mini-COBRA. Each state has different rules and regulations regarding Mini-COBRAs.
