Maine has a mini-COBRA law, which offers limited continuation coverage to employees who work for companies with fewer than 20 employees. This law provides one year of continuation coverage to eligible employees who were laid off and had previously received health insurance through a fully insured policy provided by their employer. To be eligible, the layoff must be temporary or the result of an injury or illness covered by workers’ compensation.
Mini-COBRA differs from the federal COBRA law. For example, under mini-COBRA, insurers are allowed to require a minimum of six months of employment prior to the layoff and for employees to elect coverage within 31 days of the layoff.
